Sanctions Policy
MYMARKETPLACE is an online platform connecting buyers and sellers worldwide. By using our marketplace and services, you agree to abide by this policy, which forms part of our Terms of Use. Regardless of your location, you are responsible for ensuring compliance with applicable laws and regulations.
As global company based in the UK, MYMARKETPLACE must comply with economic sanctions and trade restrictions imposed by the UK government, including those enforced by HM Treasury's Office of Financial Sanctions Implementation (OFSI). In addition, we adhere to relevant international sanctions, such as those issued by the United Nations and European Union. This means that neither MYMARKETPLACE nor its users may engage in transactions that involve sanctioned individuals, entities, regions, or restricted goods and services.
This policy applies to all users of our platform, wherever they are located. It is your responsibility to stay informed about applicable sanctions and trade restrictions.
Prohibited Transactions
Sanctions and trade restrictions generally prohibit, but are not limited to, transactions involving:
- Certain geographic regions, including (but not limited to) Crimea, Cuba, Iran, North Korea, Syria, Russia, Belarus, and the Donetsk and Luhansk regions of Ukraine, as well as any individuals or businesses operating within these areas.
- Individuals or organisations appearing on sanctions lists, such as the UK Sanctions List, OFSI’s Consolidated List, the EU Sanctions List, or the UN Security Council Sanctions List.
- Cuban nationals, regardless of their place of residence, unless they have acquired permanent residency or citizenship outside of Cuba.
- Goods originating from embargoed areas, including but not limited to Cuba, Iran, North Korea, and Crimea, except for permitted informational materials such as books, films, and artwork.
- Goods, services, or technology from the Donetsk and Luhansk regions, except for certain humanitarian, agricultural, and informational materials.
- Specific Russian-origin products, such as seafood, diamonds, gold, and any other restricted items as determined by UK regulations.
- Luxury goods or restricted exports from the UK or EU to individuals or entities based in Russia or Belarus, as defined by UK and EU trade laws.
- Products prohibited under the UK Modern Slavery Act, including those suspected of being produced using forced labour.
Enforcement and Compliance Measures
To safeguard our marketplace and ensure compliance with applicable sanctions:
- MYMARKETPLACE prohibits the use of accounts from sanctioned regions. If we detect activity from a restricted location, or suspect any violation of trade regulations, we may suspend or terminate access to our services.
- Users are generally not permitted to list, buy, or sell items originating from embargoed areas. This applies even to pre-sanctions items, as we cannot verify the timing of their removal from restricted regions.
- Shipments to or from sanctioned territories are prohibited.
- We reserve the right to request further information about an item’s origin, mandate disclosure of country of manufacture, or take other necessary steps to ensure compliance.
- Listings or transactions that pose a sanctions risk may be removed or cancelled at our discretion.
Additional Considerations
Beyond UK and EU regulations, users should be aware that other countries may impose their own trade restrictions. If a transaction involves international parties, it is your responsibility to verify and comply with all applicable laws.
Additionally, financial service providers such as banks and payment processors (e.g., PayPal, Stripe) may independently monitor transactions for sanctions compliance. MYMARKETPLACE has no authority over their decisions to block or restrict transactions.
Sanctions policies and trade laws are subject to change. We encourage users to stay informed by referring to relevant government and regulatory bodies, such as HM Treasury’s OFSI, the UK Department for Business and Trade, the European Commission, and the United Nations.
For legal advice regarding sanctions compliance, we recommend consulting a qualified legal professional.
